The petitioner apprehends his arrest in connection with Barauli (Madhopur O.P.) P.S. Case No. 275 of 2017 registered for the offences punishable under Sections 147, 148, 149, 447, 323, 385, 427, 506 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of demand of rangdari from the informant and also of harvesting the paddy crops and it appears that earlier also, the informant has lodged the case against the petitioner.
Learned counsel for the petitioner submits that the informant is in habit of lodging false case against the petitioner
Patna High Court CR. MISC. No.51157 of 2019(3) dt.16-11-2019 2/2 as earlier also, for the similar set of allegation, he has lodged a case against the petitioner. Learned counsel for the petitioner further submits that similarly situated accused persons have been granted bail by a Co-ordinate Bench of this Court dated 03.05.2019 passed in Cr. Misc. No.18087 of 2019. In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIV, Gopalganj in connection with Barauli (Madhopur O.P.) P.S. Case No. 275 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
