The petitioners apprehend their arrest in Bettiah Town P.S. Case No. 731 of 2015 registered under Sections 341, 324, 363, 307, 506/34 of the Indian Penal Code. The petitioners along with co-accused Yunus Miyan are alleged to have kidnapped the informant and confined him in a room. The petitioners are alleged to have assaulted the informant with daggers on different parts of his body. It is submitted that the father of the informant is an employee of M.J.K. Hospital and the injury report is fabricated. Yunus Mian @ Md. Yunus Mian has already been granted regular bail by order dated 15.01.2016 passed in Cr. Misc. No. 1549/2016.

Having considered the nature of allegation, I am not

Patna High Court Cr.Misc. No.9789 of 2016 (4) dt.22-06-2016 2/2 inclined to enlarge the petitioners on anticipatory bail in Bettiah Town P.S. Case No. 731 of 2015. Accordingly, the same is rejected.

If the petitioners surrender in the court below, the court below shall consider the prayer for regular bail of the petitioners taking into consideration that one of the co-accused, namely, Yunus Mian @ Md. Yunus Mian has already been granted bail, and shall dispose of the bail petition, if possible, on the same day.
