ANJANA MISHRA ORAL ORDER 29-07-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Barauli (Madhopur O.P.) P.S. Case No. 234/2017 registered for the offence punishable under Sections 147/148/ 149/ 323/379/504/506 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the only allegation against the petitioner is that he had entered the Math along with one Bhikhari Singh who is having some dispute with regard to the land of the Math for which a title suit has already been decreed in favour of the said Bhikhari Singh. Patna High Court CR. MISC. No.46891 of 2019(2) dt.29-07-2019 2/3 been granted anticipatory bail vide order dated 10.01.2019 passed in Cr. Misc. No. 75710 of 2018. The petitioner is also one of the accused in the case though there is no specific allegation against him.

Learned counsel for the State submits that there are three cases pending against the petitioners to which learned counsel for the petitioner responds that the same is in connection with the very same Math. The dispute regarding the same Math and since he is connected with the said Bhikhari Singh, he has been falsely implicated in connection with the same case though the informants are different, but it is in connection with the same Math.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate,-XIV, Gopalganj, in connection with Barauli (Madhopur O.P.)
