Heard the learned counsel for the petitioners and learned APP for the State through video conference. The petitioners apprehend their arrest for the offences alleged under Sections 147, 148, 149, 188, 269, 353, 307 and 504 of the Indian Penal Code, registered in connection with Town P.S.(Sikandarpur O.P.) Case No.302 of 2020.
Patna High Court CR. MISC. No.13197 of 2021(2) dt.07-01-2022 2/3 The allegation against the accused persons including the petitioners is that they created road jam and by flouting the norms of social distancing, they interrupted the officials in discharge of their official duty.
The learned counsel for the petitioners has submitted that they are ladies. The son of petitioner no.5 was badly assaulted by some miscreants and in this respect Town P.S.Case No. 298 of 2020 was registered and the police was not taking action against the accused persons in that case. As such, the accused persons were making protest against the police and administration.
Considering the facts and circumstances as well as the fact that the petitioners are ladies, let the petitioners abovenamed, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Town P.S. (Sikandarpur O.P.) Case No. 302 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
