The petitioner seeks regular bail in connection with Rosera P.S. Case No.274 of 2017 registered for the offences punishable under Section 354(B) of the Indian Penal Code and Section 8 of POCSO Act.

As per written report, the allegation against the petitioner is that he forcibly wanted to hand over mobile and written chit of paper/letter to the niece of informant. It has been submitted that no offence under section 354(B) of I.P.C. is made out. The alleged mobile and letter have been produced by the informant. The petitioner is in custody since 15.11.2017 having clean antecedent.

Patna High Court Cr.Misc. No.30346 of 2018 (3) dt.03-07-2018 The learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer of bail is allowed. The petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Special Judge, POCSO Act, Samastipur in connection with Rosera P.S. Case No.274 of 2017 corresponding to Trial No.51 of 2018.
