The petitioner is seeking regular bail in Samastipur (T) P.S. Case No. 99/18 registered under Sections 147, 148, 149, 307 of the Indian Penal Code and Sections 25(1-B)A, 26, 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R., he has no criminal antecedents and was not arrested from the alleged place of occurrence. It is further submitted that in the alleged occurrence nobody has been injured, no arms or ammunitions have been recovered from the possession of the petitioner. Learned A.P.P. for the State is present.

No.32288 of 2018 (3) dt.12-06-2018 2/2 Considering the facts and circumstances that nothing has been recovered from the possession of the petitioner, he is not named in the F.I.R. and he has no criminal antecedents, let the petitioner, named above, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur in connection with Samastipur (T) P.S. Case No. 99/18, subject to the conditions as laid down under Section 437(3) Cr.P.C.
