JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 272, 273, 420/34 of the Indian Penal Code and 47a of the Excise Act.
On secret information, the brick-kiln of the petitioner was raided when from the different rooms occupied by laborers seventy three litres country made liquor were recovered. It is submitted by learned counsel for the petitioner that actual recovery was not made from the possession of the petitioner and petitioner used to reside 5 k.ms. away from the brick-kiln. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or
Patna High Court Cr.Misc. No.8946 of 2016 (2) dt.25-02-2016 2/2 surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Bijaipur P.S. Case No.8 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
