JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 447,341,323,324,307 and 504/34 of the Indian Penal Code.
It is alleged that when the informant making ridge in his field for stopping flow of water, co accused Rahim Mian (non petitioner) came with six persons along with petitioner and twice assaulted the informant with Farsa causing injury on his head and neck. It is further alleged that all the accused persons also assaulted the informant.
It is submitted by the learned counsel for the petitioners that in the background of serious land dispute the accusation has
Patna High Court Cr.Misc. No.7728 of 2015 (2) dt.26-02-2015 2/2 been levelled. The accusation against the accused persons including the petitioner except Rahim Mian is omnibus and general. It is further submitted that considering the aforesaid facts, co accused persons have been granted anticipatory bail vide Cr. Misc. No. 3714 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari in connection with Raxaul P.S. Case No. 178 of 2014 subject to the conditions as laid down under Section 438(2) Cr.P.C.
