====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 16-05-2018 Heard learned counsel for the petitioner and the State. This is an application for regular bail in connection with Wazirganj P.S. Case No.366 of 2017 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 307, 364, 379 of the Indian Penal Code.

It is alleged that the petitioner armed with Iron rod along with co-accused persons armed with revolver, hockey, Lathi and Danda assaulted the informant with an intention to kill him. In the injury report three lacerated wounds were found in skull region and two swellings on the body. It is submitted on behalf of the petitioner that he is innocent and he has falsely been implicated in the present case. He was not present on the place of occurrence. He is in judicial

Patna High Court Cr.Misc. No.30431 of 2018(2) dt.16-05-2018 2/2 custody since 22.08.2017.

Earlier prayer for bail of petitioner was rejected by this Court in Cr. Misc. No. 7428 of 2018 vide order dated 7.3.2018 with an observation that he may renew his prayer for bail after completion of eight months in custody. Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Gaya, in connection with Wazirganj P.S. Case No.366 of 2017.
