JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 11-02-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in registered for the offences punishable under sections 395/397 of the Indian Penal Code and sections 3⁄4 of the Explosive Substance Act. As per the prosecution case, 8 to 10 miscreants forcibly entered the shop of the informant, exploded bombs, looted cash Rs.2.10 lacs, ornaments worth Rs.5 to 6 lacs, mobile phone, Aadhar card and PAN Cards.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation. No incriminating material has been recovered from the conscious possession of the petitioner. Test Identification Parade has not been carried out till date. Petitioner is in custody since 6.1.2020.

Learned counsel for the State opposes the prayer for bail and submits that on the confessional statement of the

Patna High Court CR. MISC. No.60381 of 2021(2) dt.11-02-2022 2/2 petitioner, police recovered looted Aadhar card of informant's wife and looted ornaments and cash from the house of the petitioner.

Considering the nature of accusation and gravity of offence, prayer for bail of the petitioner is refused. (Prabhat Kumar Singh, J) Shashi U T
