Patna High Court CWJC No.3370 of 2017 dt.25-09-2018 2/3 In this case, the petitioners have raised a very limited grievance that from the panel of the year 2013, large number of persons have been illegally appointed leaving the seniors in the panel in lurch and juniors have been appointed. A panel was prepared in the year 2013 for the purpose of appointment of Executive Assistant on contract basis. Accordingly, the petitioners and others have applied, a panel was prepared for one year but, the life of the panel was extended for three years and, after that, the Collector declared the panel canceled vide letter no. 1142 dated 17.11.2016 but, learned counsel for the petitioners submits that one Alok Kumar, falling under the E.B.C. category and ranking most below the present petitioners has been accommodated and the petitioners have been left out. In the present case, two categories of the petitioners are here, some are under B.C. category and some are under E.B.C. category but, the example of Alok Kumar has been shown who belongs to the E.B.C. category.
Let the Collector, Munger, should re-visit the entire appointment made in the Munger Collectorate and if any wrong is found to have been committed, the person, who has been illegally accommodated, must be removed after giving them due notice.
Patna High Court CWJC No.3370 of 2017 dt.25-09-2018 3/3 It is not known to this Court whether Alok Kumar is junior in panel or is senior, if Alok Kumar is junior and still has been appointed vide Memo No. 821 dated 1.9.2016, he must be removed from service after giving due notice of hearing to him. With the aforementioned observation and direction, this writ application is disposed of.
