JUSTICE PARTHA SARTHY ORAL ORDER 05-04-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has filed the instant application for grant of regular bail in connection with Itarhi P.S. Case no. 126 of 2020 registered under sections 420, 406 and 409 of the Indian Penal Code.

As per allegation in the FIR, it is stated by the informant that the petitioner surreptitiously obtained money receipt of the power distribution company, used the same and caused loss of Rs. 4300/- to the company.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. No person or consumer has come forward to make any complaint against the petitioner. It is submitted that the

No.6598 of 2021(2) dt.05-04-2021 2/2 petitioner does not accept the allegation as levelled in the FIR, however, a sum of Rs. 4300/- has already been deposited by the petitioner in the department. He is in custody since 30.9.2020, has no criminal antecedent and charge sheet has been submitted in the case.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the period in custody together with charge sheet having been submitted, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Itarhi P.S. Case no. 126 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 4th, Buxar.
