Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Barachatti (Mohanpur) P.S. Case No. 438 of 2019, lodged under Sections 302/201 of the Indian Penal Code.

As per the prosecution case, the Chowkidar of village who is the informant in this case has intimated that a dead body was found hanging in a Mahua tree.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence, F.I.R. has been lodged against unknown persons. He further submits that deceased was a person who is interested to marry with the

Patna High Court CR. MISC. No.60233 of 2021(4) dt.10-10-2022 2/2 daughter of petitioner, which was opposed by the petitioner. Learned counsel for the petitioner also submits that petitioner is a poor lady aged about 56 years and is completely innocent, her antecedent is clean and she is in custody since 07.03.2021. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 438 of 2019, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
