JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 05-08-2025 Heard Mr. Rajeev Kumar, learned counsel for the petitioner and Mr. Ramchadra Sahni, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending her arrest in connection with Maner P.S. Case No. 912 of 2021 instituted for the offence under Sections 30(a), 30(c), 32(iii), 34, 36 & 41 of the Bihar Prohibition & Excise Act.

3. The case of the prosecution is that the petitioner is a woman and from her house, altogether 6 liters of illicit liquor was recovered.

4. Learned counsel appearing on behalf of the petitioner has submitted that the petitioner is innocent and has committed no offence. She has falsely been implicated in this case. He also submits that from perusal of the seizure list, it will transpire that the recovery has been made from the house of the petitioner, whereas in the fardbeyan, the recovery was made

He next submits that the petitioner is a lady and she has got no concern with the alleged recovery. He further submits that a statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. It has lastly been submitted that similarly situated other co-accused person namely, Anju Devi has already been granted bail by Co-ordinate Bench of this Court vide order dated 10.04.2024 in Cr. Misc. No. 27360/2024.

5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.

6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of her arrest or surrender in connection with Maner P.S. Case No. 912/2021, she will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge, Danapur, Patna, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
