JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 28-04-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Under deceitful manner, informant Gongu Mahto was taken away by Dhaneshwar Yadav to the place of Bambam Singh, who along with the petitioner Dhiraj Singh as well as Mantun Singh confined in a room and on the pretext of firearm, took L.T.I. Subsequently thereof, he was released. The matter was to be reported to the police, however, Mukhiya and Sarpanch persisted him to have a solution at their level. It has also been disclosed that accused persons are preparing to plough his field which he had purchased from father of Bambam Singh in the year 1997.

Thumb Impression is not a valuable security till it is converted like so and on account thereof, the allegation as

No.7142 of 2015 (03) dt.28-04-2015 well as subsequent eventualities as is visualizing from the case diary did not support the contention of the prosecution that it, uptill-now been, used like so. That being so, petitioner is directed to surrender before the learned lower Court with a prayer of bail which, the learned lower Court will consider favourably in light of direction given herein above.

With the aforesaid observation, instant petition is disposed of.
