The petitioner seeks bail in a case registered under Sections 406, 409, 419, 420, 467, 468, 471, 120B of the Indian Penal Code and Section 13(2) R/W Section 13(1)(c)(d) of P.C. Act, 1988.

Prosecution case, in short, is that on the basis of forged transfer letter the petitioner joined as a teacher in Primary School and withdrew Rs.1,13,033/- illegally. It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.04.2019 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been

Patna High Court CR. MISC. No.50399 of 2019(2) dt.14-08-2019 2/2 made accused due to mistake of fact. Joining given by the petitioner is said to be on the basis of fake document. The petitioner had no knowledge that the document in question is fake one.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned I/c Special Judge (Vigilance), North Bihar, Muzaffarpur in connection with Chhauradano P.S. case No.66 of 2003.
