2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 302, 379, 448 and 34 of the Indian Penal Code.
3. Lastly, the prayer for grant of bail to the petitioner was rejected by a Co-ordinate Bench of this Hon'ble Court vide order dated 04.09.2024 passed in Cr. Misc. No. 62286 of 2024 with a direction to expedite the trial and conclude the same at the earliest.
4. Even after lapse of one year of the last order passed by a Co-ordinate Bench of this Hon'ble Court, the trial has yet not been concluded and 5 charge-sheeted witnesses are yet to be
Patna High Court CR. MISC. No.51847 of 2025(2) dt.19-09-2025 2/2 examined. Petitioner is in custody since 14.07.2023.
5. Considering the aforesaid facts and circumstances of the case, tardy progress of trial and period of custody, the prayer for grant bail of to the petitioner is allowed.
6. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge XIX, East Champaran at Motihari in connection with Ghorasahan (Lakhaura) P.S. Case No. 45 of 2021.
