22-06-2021 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Patahi P.S. Case No. 64 of 2016, registered for the offence under Section 366(A) of the Indian Penal Code.

As per the prosecution case, this petitioner is alleged to have abducted the minor daughter of the informant. It is submitted on behalf of petitioner that petitioner is not named in the FIR and during course of investigation, his name has surfaced. In the statement, recorded under Section 164 of the Cr.P.C., neither the victim has alleged any overt act against the petitioner nor uttered any foul against the petitioner. It is further submitted that the informant has entered into a compromise with the petitioner and to this effect, a compromise petition has been filed in the court below, in which, it has been stated that victim has already been married with one Raushan

Patna High Court CR. MISC. No.6362 of 2021(3) dt.22-06-2021 2/2 Kumar on 19.07.2017 and she is leading a conjugal life. Petitioner claims clean antecedent and he is in custody since 20.06.2020. Chargesheet has been submitted.

However, learned A.P.P. for the State opposed the bail petition and submitted that there is specific allegation against the petitioner of kidnapping the minor daughter of the informant, which has already been supported by the victim girl in her statement recorded under Section 164 of the Cr.P.C. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
