Mr. Binod Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Aurangabad Mahila P.S. Case no. 14 of 2019, registered under Sections 498(A), 379, 376, 341, 323, 504 and 506/34 of the Indian Penal Code and Section 3 / 4 of Dowry Prohibition Act.

Learned counsel appearing on behalf of petitioner and O.P. No.2 submits that petitioner and O.P. No.2 are husband and wife and they have settled their dispute, amicably, out of Court in terms of paragraph Nos. 2 and 3 of the compromise petition filed by both the parties on 28.11.2019,

Patna High Court CR. MISC. No.47231 of 2019(9) dt.06-02-2020 2/2 which is kept on record. Learned counsel for the petitioner submits that in terms of the aforesaid paragraphs, a bank draft of Rs. 12,50,000/- has already been prepared and, today, he is handing over the same to Sri Abhay Kumar, Advocate, appearing on behalf O.P. No.2 for handing over the same to O.P. No.2.

Learned counsel appearing on behalf of O.P. No.2 submits that he is ready to receive the said bank draft of Rs. 12,50,000/- and the same would be handed over to O.P. No.2. Having regard to the facts and circumstances of the case and the fact that the dispute between the parties has been settled, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M. Aurangabad in connection with Aurangabad Mahila P.S. Case No. 14 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
