The petitioners apprehend their arrest in connection with Rajoun P.S. Case No.394 of 2018 registered for offences under Sections 341, 323, 325, 307, 379 and 504/34 of the Indian Penal Code.
At the very outset, learned counsel for the petitioners submits that petitioner no. 5, namely, Sikandar Yadav has been
Patna High Court CR. MISC. No.6825 of 2021(2) dt.29-11-2021 2/2 arrested during the pendency of this application. Hence, he prays for withdrawal of the application.
Prayer is allowed. The application for anticipatory bail is dismissed as withdrawn so far as petitioner no. 5, namely, Sikandar Yadav is concerned.
So far as other petitioners are concerned, the allegation against them is of having assaulted the injured on trivial issue.
Accordingly, let petitioner nos. 1, 2, 3, 4, 6, 7 and 8, namely, Santosh Yadav, Subodh Yadav, Kumod Yadav, Vikash @ Bika Yadav, Prabha Devi, Bpuja Devi and Bindu Devi @ Gyatri Devi, in the event of their arrest or surrender within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate/ Successor Court, Banka, in connection with Rajoun P.S. Case No.394 of 2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
