The petitioner seeks anticipatory bail in connection with Mojahidpur P.S. Case No. 137 of 2010 registered for the offence punishable under Section 414 read with 34 of the Indian Penal Code.
It has been contended that the petitioner is neither named in the FIR nor any incriminating article has been recovered from his possession. His name transpired in course of investigation on the basis of confessional statement of coaccused.
Patna High Court Cr.Misc. No.42246 of 2014 (2) dt.20-03-2015 2 / 2 Regard being had to the long standing criminal history of the petitioner as also the fact that the police may require custodial interrogation of the petitioner, I am not inclined to grant him anticipatory bail. Accordingly, the prayer for anticipatory bail is rejected.
