JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 363/366A/379/34 of the Indian Penal Code.
Prosecution case is that on 06.08.2015, the minor daughter of the informant went to school but from where she went missing. Subsequently, the informant came to know that she took with herself Rs.25,000/- cash, jewellary and other articles when informant suspected that the petitioner and other abducted her daughter.
It is submitted by learned counsel for the petitioner that in 164 Cr. P. C. statement the victim got her age recorded as 17 years wherein she has stated that she of her own left the house due to the torture inflicted by her parents and the present case has
Patna High Court Cr.Misc. No.8915 of 2016 (2) dt.25-02-2016 2/2 falsely been lodged. The victim has not named the petitioner in her statement. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering 164 Cr.P.C. statement of the victim girl, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Buxar, in connection with Dhansoi P.S. Case No.69/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
