The petitioner seeks regular bail in connection with Danapur P.S. Case No. 47 of 2018 for the offences punishable under Section(s) 25(L-b)a/26 Arms Act.
The allegation is regarding recovery of one loaded countrymade pistol and five live cartridges recovered from the first floor of the house of the petitioner.
The learned counsel for the petitioner submits that the petitioner is innocent and the petitioner lives on the ground floor of the house whereas the recovery has been made from the first floor of the house, hence the petitioner has been falsely implicated in the present case. It is further submitted that the petitioner is languishing in custody since 31.01.2018.
Patna High Court Cr.Misc. No.32038 of 2018 (2) dt.24-05-2018 2/2 Having regard to the facts and circumstances of the case, it is directed that the petitioner be released from custody on bail immediately upon completion of six months of custody subject to such condition as may be imposed by the learned Additional Chief Judicial Magistrate-I, Danapur in connection with Danapur P.S. Case No. 47 of 2018.
