JUSTICE ARUN KUMAR ORAL ORDER 17-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody seeks bail in Masrakh PS Case No. 246 of 2016 , S.T. No. 56 of 2017, registered under Sections 413 and 414 of the IPC.

The allegation in brief is that during investigation it transpired that the petitioner used to make duplicate key and provide it to others who used to commit theft of motorcycle. Learned Counsel for the petitioner submits that the petitioner has been made accused on the statement of Suresh Patwa, neither any stolen motorcycle was recovered from his possession nor any duplicate key and charge-sheet has been submitted, though he has cases against him but he is on bail in those cases. Having considered the said facts and circumstances, the petitioner, namely, Hari Kishore Prasad is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge X Saran in connection with Masrakh PS Case No. 246 of 2016, S.T. No. 56 of 2017.
