JUSTICE SUDHIR SINGH ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 467, 468, 471, 353 and 120B of the Indian Penal Code and 65(17) of Drugs & Cosmetics Act. Prosecution case is that petitioner along with others were running Nursing Home in the name and style as " Gramin Seva Kendra" without valid certificates.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He has been made accused due to mistake of fact. The allegation made in the F.I.R. is denied by the petitioner. The other co-accused has been granted regular bail vide Cr. Misc. no. 49795 of 2015.
On behalf of the State, it is submitted that petitioner is named in the F.I.R. and other co-accused has been granted regular bail.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner, same is rejected.
Any how, if petitioner surrenders in the court below, i.e.,
Patna High Court Cr.Misc. No.10895 of 2016 (2) dt.18-04-2016 2/2 Sri Aditya Pandey, learned J.M., Ist Class, Vaishali at Hazipur in connection with Patepur P. S. Case no. 111 of 2015 within a period of six weeks from the date of receipt of a copy of this order and prays for regular bail, same shall be considered and disposed of taking into account that other accused has been granted regular bail preferably on the same day without being prejudiced by this order.
