The petitioner seeks regular bail in connection with Case No. C2/223/18 for the offences punishable under Section 30(A) of the Bihar Prohibition & Excise Act, 2016. The allegation is regarding recovery of 18 liters of illicit Nepali wine from Indo Nepal Border.
The learned counsel for the petitioner submits that neither any recovery has been made from the conscious possession of the petitioner nor the petitioner has got anything to do with the illicit liquor recovered by the police. The petitioner is stated to be languishing in custody since 22.4.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on
Patna High Court Cr.Misc. No.30808 of 2018 (2) dt.22-05-2018 2/2 bail, on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.D.J.-II cum Special Judge, Excise Act, Sitamarhi in connection with C2/223/28.
