The petitioners apprehend their arrest in connection with Pirpainti P.S. Case no. 83 of 2015 registered under Sections 341, 323, 324, 308, 504 and 506/34 of the Indian Penal Code. The allegation of informant Bibi Rubi is that on 31.03.2015, informant went at the house of Md. Kausar for asking to give the money, which was taken by him on which Md. Kausar started abusing, when she made protest in the meantime, petitioners Md. Kalo and Md. Tajjo came armed with Khanti, Lathi and stick and started assaulted her causing injury, when her husband Md. Jago Ansari rushed to save her, then Md. Kausar caused injury to him at his head. Learned counsel for the petitioners submit that, in fact,

No.9856 of 2016 (3) dt.02-05-2016 2/2 the occurrence had taken place in between petitioners and informant, but at the time of alleged occurrence hot talk exchanged in between the parties in which Md. Kaushar and other family member of the petitioner have also sustained injuries regarding which Pirpainti P.S. Case No. 84 of 2015 was also instituted, but due to ulterior motive, the petitioners have also been implicated in this case. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Pirpainti P.S. Case No. 83 of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
