2. The petitioner seeks regular bail in connection with Special (NDPS) Case No.38 of 2020, arising out of Jakkanpur P.S. Case No. 151 of 2020, lodged on 27.02.2020, under Sections 8(C)/21(C)/25/29 of the N.D.P.S. Act. Recovery of 2111 grams of brown sugar has been the subject matter of the present case.
3. This is the third attempt of the petitioner. Earlier bail application of the petitioner was rejected vide orders dated 14.11.2022 and 10.11.2023 passed in Cr. Misc. No.61944 of 2021 and Cr. Misc. No.63827 of 2023. On earlier occasion the Trial Court has been directed to expedite the trial.
4. From perusal of the progress report it transpires to
Patna High Court CR. MISC. No.55306 of 2024(5) dt.12-02-2025 2/2 this Court that out of 8 witnesses four witnesses have already been examined and rest four witnesses have to be examined.
5. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioner. Hence, the prayer for bail of the petitioner is hereby rejected. The Trial Court is directed to expedite the trial.
6. The Senior Superintendent of Police, Patna, is directed to do the needful for production of witnesses and shall issue necessary instruction to the S.H.O./I.O. of the case to produce the witnesses within six months from the date of receipt/production of a copy of this order.
7. Office and APP is hereby directed to inform about this order to the Senior Superintendent of Police, Patna, forthwith.
