JUSTICE DINESH KUMAR SINGH ORAL ORDER 25-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 466 and 468 of the Indian Penal Code.

The prosecution case is that the petitioner got the land of the complainant's share mutated in his name. It is submitted by learned counsel for the petitioner that the accusation has been levelled in the background of civil nature of dispute when the share was divided between the petitioner and the complainant in pursuance to the compromise entered into Title Suit No. 04 of 1991. Considering the accusation based on civil flavor of dispute, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Khagaria in connection with Complaint Case No. 242C of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
