2. The petitioners apprehend their arrest in connection with Buxar Town P.S. Case No.233 of 2024 instituted under Sections 498A, 366/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
3. As per the prosecution case, the daughter of the informant was married with the petitioner, namely, Sanjay Singh @ Sanjay Kumar on 06.12.2020. There is allegation of dowry demand against the petitioners and the daughter of the informant is missing from her matrimonial home. It is also alleged that petitioner-Sanjay Kumar had illicit relationship with another girl.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. He further submits that when the petitioners came to know that daughter of the informant is missing then they searched her and also inform the informant and his family members about the missing. Learned counsel also submits that the daughter of the informant has been seen in CC TV Footage near their neigbour's house and sitting in E-Rickshaw in the morning and also she had been seen at Buxar Railway Station on that day. 5. Learned A.P.P. for the State as well as learned counsel for the informant oppose the prayer of the petitioners for anticipatory bail.
6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Buxar / Concerned Trial Court in connection with Buxar Town P.S. Case No.233 of 2024, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
