The petitioners apprehend their arrest in Hajipur Town P.S. Case No. 871 of 2014, registered for the offences punishable under Sections 354, 379 and some other Sections of the Indian Penal Code.

Ruby Gupta the wife of Ashok Gupta made allegations against the petitioners that they entered into her house torn her clothes and committed theft of different articles and assaulted her. Learned counsel for the petitioners submits that Ashok Gupta is non-else than own brother of petitioner Dablu Kumar. Petitioner No. 2 is brother-in-law of petitioner no. 1. Earlier Puja Gupta the wife of the petitioner filed Hajipur (Town) P.S. Case

Patna High Court Cr.Misc. No.5950 of 2015 (2) dt.13-02-2015 2/2 No. 600 of 2013 under Section 498A and other Sections of the Indian Penal Code against Ashok Gupta. The wife of the petitioner filed Hajipur (Town) P.S. Case No. 870 of 2014, registered under Sections 354, 379 and other Sections of the Indian Penal Code against Munna Kumar, Ashoak Kumar and Ruby Devi, thereafter the wife of Ashok Kumar Gupta lodged this case. It appears that Ashok Kumar Gupta is brother of the petitioner Dablu Kumar. The petitioner and his brother Ashok Kumar Gupta are fighting with each other, but they put forward their wives and lodged the case against each other.

Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Tow P.S. Case No. 871 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
