JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-08-2019 This application, for grant of anticipatory bail, arises out of Bhargama P.S. Case No. 90 of 2017, disclosing offences under Sections 147, 148, 149, 341, 323, 324, 325, 427, 307, 379, 354(B), 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation according to F.I.R. is that petitioners came variously armed and petitioner no. 1 assaulted the informant by means of farsa on his head, petitioner no. 2 assaulted one Chottu Kumar by means of iron rod on his hand and petitioner nos. 3 and 4 also assaulted the informant and others.

No.50190 of 2019(2) dt.13-08-2019 2/2 Submission of learned counsel for the petitioners is that there is case and counter case between the parties and although there is allegation of assault against the petitioner but the injuries sustained by the informant and others were found simple in nature except one injury, which is said to have been inflicted by petitioner no. 2 on one Chootu Kumar but that is not on the vital part of the body.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Bhargama P.S. Case No. 90 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
