JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 461 and 379 of the Indian Penal Code.

The accusation is of committing theft in the shop of the informant.

It is submitted by learned counsel for the petitioner that there is tenancy dispute between the informant and maternal grand-father of the petitioner when Evection Title Suit No. 59 of 2014 is pending between them and the petitioner has been roped in the present case only because he happens to be the grand-son of the landlord of the shop of the informant.

The aforesaid facts constitute good ground for consideration of prayer for regular bail.

Patna High Court Cr.Misc. No.5861 of 2015 (2) dt.13-02-2015 2/2 Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Kotwali (Gaya) P.S. Case No. 629 of 2014 pending in the court of learned CJM, Gaya. Accordingly, the application is disposed of.
