The petitioners seek bail in a case instituted for the offences under Sections 302, 201 and 120B of the Indian Penal Code.

The prosecution case in short is that the father of informant left the house and did not return, later his dead body was found.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 24.3.2019 and have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. Charge-sheet has been

Patna High Court CR. MISC. No.47012 of 2019(2) dt.01-08-2019 2/2 submitted in the present case. The petitioners have falsely been implicated in the present case. It is a case of last seen. There is no eye witness to the alleged occurrence. Except for suspicion, there is no other substantive evidence to suggest their implication in the present case.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Katihar in connection with Azamnagar P.S. Case No. 74/2019.
