The petitioners apprehend their arrest in Kharagpur P.S. Case No. 86 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named the petitioner along with Santosh Paswan and alleged that they assaulted him. The informant made specific allegation against Santosh Paswan that he assaulted the informant with iron rod on his head. It is further alleged that the accused persons also assaulted Vijay Paswan, Bambam Paswan and Dharo Mandal.
It appears that no specific allegation of assault is made against the petitioners. All the injured got simple injuries. The
Patna High Court Cr.Misc. No.4932 of 2015 (3) dt.11-02-2015 2/2 informant got one injury on head which is simple in nature. Considering the facts aforesaid the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Learned SubDivisional Judicial Magistrate, Munger in connection with Kharagpur P.S. Case No. 86 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
