JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-09-2019 The learned counsel appearing for the respondent no. 7 has filed a supplementary counter affidavit, wherein it has been stated that both the wives have entered into an agreement to divide the retiral dues of the deceased employee. The learned counsel appearing for the petitioner does not dispute the said position.

In such view of the matter, it will be for the government to decide as to who will get the retiral dues. For the said purpose, I deem it fit and proper to grant liberty to the petitioner and the respondent no. 7 to approach

Patna High Court CWJC No.3005 of 2017(8) dt.02-09-2019 2/2 the respondent no. 4 who shall adjudicate with regard to the person entitled to the retiral dues of the deceased employee, within a period of four weeks of making such a representation. It is made clear that the adjudication and the final payment should be made within a period of eight weeks of the petitioner and the respondent no. 7 approaching the respondent no. 4.

The writ petition stands disposed off on the aforesaid terms.
