2. The petitioners have preferred this application for grant of anticipatory bail in connection with Biraul P. S. Case No. 485 of 2025 registered for the offences punishable under Sections 329(3), 126(2), 115(2), 118(1), 303(2), 76, 352, 351(2), 3(5) and 113(2) of B.N.S.

3. The case of the prosecution, in short, is that on 21.11.2025 in a pre-planned manner the petitioners and some unknown persons laced with weapons came to the house of the informant and started abusing. Upon protest, on instigation of co-accused Ramnandan Yadav, all the accused persons assaulted

Patna High Court CR. MISC. No.49517 of 2026(2) dt.22-07-2026 2/3 the informant, as a result of which he fell on the ground. When his family members came to save him, they were also assaulted. It is alleged that petitioner no. 1 snatched gold chain of informant's wife and petitioner no. 2 assaulted Rambalak Yadav by means of lathi on his head.

4. Learned counsel for the petitioners submits that petitioners are quite innocent and have falsely been implicated in this case due to previous land dispute between the parties. There is case and counter case between the parties. All Sections are bailable in nature except Sections 303(2), 76, 118(1) of B.N.S., which are not attracting against the petitioners. There is delay of three days in lodging the FIR. Allegedly, petitioner no. 2 has assaulted to Rambalak Yadav but his injury is simple in nature as mentioned in Para 11 of the petition. Allegedly, the allegation of snatching gold chain against petitioner no. 1, is ornamental in nature. Moreover, it is mentioned in Para 3 of the petition that petitioners have no criminal antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

6. Keeping in view the aforesaid facts and considering the clean antecedent of the petitioners, let the petitioners, above

No.49517 of 2026(2) dt.22-07-2026 3/3 named, be released on anticipatory bail in the event of arrest or surrender within a period of four weeks from the date of receipt of this order, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-I, Biraul, Darbhanga in connection with Biraul P.S.
