JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-06-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Gaya Excise Case No. 136 of 2018 for the offence under Section 30(a) of the Bihar wine Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has remained in custody since 10.04.2018. Counsel further submits that alleged recovery was made from the Motor Cycle and not from the conscious possession of the petitioner is not the owner of the Motor Cycle or the liquor.
