Petitioner, already in custody, seeks bail in connection with Khajauli PS Case No.206 of 2016, registered under Sections 302 and 34 of the Indian Penal Code as well as under under Section 27 of the Arms Act.

It is submitted that there was dispute regarding cutting of soil and it is alleged that the petitioner and others were assaulting the son of the informant with fists and slaps but there is no allegation against the petitioner of killing the deceased rather it is specific against one Md. Zafar who shot at him causing his death, moreover this petitioner has no criminal antecedent and one similarly situated accused, Md. Shakil Ahmad @ Bechan has been admitted to bail by a co-ordinate Bench of this Court vide

Patna High Court Cr.Misc. No.30632 of 2018(2) dt.17-05-2018 2/2 Cr. Misc. No.58667 of 2017 on 12.12.2017.

Having considered the aforesaid facts and circumstances, petitioner Md. Sohel @ Md. Suhail @ Md. Suhel is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Madhubani in connection with Khajauli PS Case No.206 of 2016.
