JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 341, 324, 307/34 of the Indian Penal Code.
The prosecution case is that the informant was returning home when he was intercepted by the petitioner and co-accused, Chandrama Singh. Chandrama Singh caught hold of the informant and petitioner assaulted him with knife on his chest and waist. Learned counsel for the petitioner submits that there is counter version of the occurrence also but admits that two stab injuries have been found on the informant but opinion regarding nature of injuries has been kept reserved. It is further submitted that informant has retracted from his earlier version and filed a
Patna High Court Cr.Misc. No.9015 of 2016 (2) dt.26-02-2016 2/2 petition before the court below to that effect. Let the learned court below consider the prayer for regular bail of the petitioner in case the petitioner surrenders within six weeks from today in connection with Bhagwanpur Hat P.S. case No. 205 of 2015 pending in the court of Sri M. K. Srivastava, learned J.M., Siwan.
