The petitioner seeks bail in connection with Ramgarhwa P.S. Case No. 21 of 2018 registered for the offences punishable under Section 376 of the Indian Penal Code and Section 4 of the POSCO Act.

The allegation is regarding commission of untoward incident with the victim girl who is said to be mentally retarded. The learned counsel for the petitioner submits that only on the basis of suspicion the petitioner has been falsely implicated in the present case whereas the fact is that no such incident has taken place especially in view of the medical report which is self speaking. The petitioner is stated to be having a clean antecedent

Patna High Court Cr.Misc. No.31590 of 2018 (4) dt.19-07-2018 2/2 and is languishing in custody since 06th February, 2018. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge-cum-Special Judge, East Champaran at Motihari in connection with Ramgarahwa P.S. Case No. 21 of 2018.
