JUSTICE V.N. SINHA ORAL ORDER 20-02-2015 Heard learned counsel for the petitioner, the State and the counsel for the informant.

2. Petitioner Branch Manager, State Bank of India, Parbatta Branch, is apprehending his arrest in connection with a complaint case registered for the offences under Sections 406, 420 of the Penal Code. It is submitted on his behalf that he is being hounded in the present case by a borrower of the Bank, whose son's truck petitioner had seized as the son failed to clear the advance. In this connection, counsel for the complainant pointed out that a sum of Rs. 1 lac was taken in fixed deposit without the instruction of the complainant by forging his signature over payin-slip dated 25.01.2014 and the debit slip also of the same date.

3. Let petitioner appear before the court below within

Patna High Court Cr.Misc. No.35060 of 2014 (2) dt.20-02-2015 2/2 a period of four weeks from the date of receipt/ production of a copy of this order in the court below and produce the original of the aforesaid pay-in-slip and debit slip, whereafter the admitted signature of the complainant be taken and matched with his signature on the original of the aforesaid pay-in-slip and debit slip. If the two signatures match with each other, petitioner, named above, be admitted to the privilege of bail on furnishing bail bond of Rs. 5,000/-(Five Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Khagaria in connection with Complaint Case No. 416C/2014, subject to the condition laid down under Section 438(2) Cr.P.C., otherwise dealt with in accordance with law. Until report from the Forensic Expert on the two signatures is received, no coercive steps be taken against the petitioner.
