The petitioner apprehends his arrest in a case registered under Section 420 and other sections of the Indian Penal Code.
In sum and substance, the allegation is that the petitioner fraudulently got the power of attorney and got the land of the informant transferred in his name.
It is submitted that the petitioner did not commit any forgery. It is admitted that the father of the petitioner was looking after the land of the informant. The petitioner filed a petition before the Circle Officer for giving him occupancy raiyat status on the disputed land and the Circle Officer vide order dated 22.01.2014 found the petitioner in continuous possession of the land and, accordingly, granted him occupancy raiyat status.

No.6811 of 2015 (2) dt.19-02-2015 2/2 Considering the fact that the dispute is of civil nature, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Baroon P.S. Case No. 52/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
