The petitioner seeks bail in connection with Simri P.S. Case No. 36 of 2018 for the offence punishable under Section 30(a) of the Bihar Prohibition & Excise Act, 2016. The allegation is regarding recovery of 198 liters of illicit liquor from a Scorpio vehicle.

The learned counsel for the petitioner submits that neither the vehicle belongs to the petitioner nor the petitioner was apprehended from the spot and his name has merely been dragged in the present case upon confessional statement of the co-accused persons namely Anil Paswan arrested from the spot. It is submitted that the petitioner is having a clean antecedent and he is languishing in custody since 31.03.2018.
