This application has been filed under Section 482 of the Cr.P.C. against the order dated 11.10.2012 passed in Case No.238M of 2012, whereunder the Sub Divisional Magistrate, Raxaul, East Champaran converted the proceeding of Section 144 Cr.P.C. in Section 145 Cr.P.C. with direction to parties to file their written statement and documents.

On going through the order dated 21.06.2012, it appears that the learned S.D.M. Raxaul on perusal of the show cause of the parties arrived at a conclusion that there is dispute regarding possession of the land and accordingly he converted the proceeding under Section 144 Cr.P.C. into Section 145 Cr.P.C. I find no illegality

Patna High Court Cr.Misc. No.30804 of 2014 (4) dt.27-06-2016 2/2 to interfere with the same in extraordinary jurisdiction under Section 482 Cr.P.C. and accordingly the present application is dismissed. (Rajendra Kumar Mishra, J) manish/- U T
