In course of hearing of CWJC No.25584 of 2013 filed by Nishant Kumar Trivedi 1st respondent herein, the learned single Judge passed the order dated 13.1.2015 directing the Chairman of the Indian Oil Corporation, to himself file an affidavit and explain

Patna High Court LPA No.389 of 2015 (5) dt.23-06-2015 2/2 the matter, in the light of the observations made by the Court. According to the respondents, pleadings in the counter affidavit have already been delivered and they do not intend to add further.

The appeal was heard at length on 22.5.2015 and a request was made to the learned single Judge to take up the application for modifiying/vacating of the order. It was brought to out notice that through detailed order dated 22.5.2015, the learned single Judge modified the interim order.

In course of hearing, pleadings of the parties need to be taken into account, and it shall not be necessary for the Chairman to file any further affidavit.

With this observation, the L.P.A. is closed.
