JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 354(B)/34 and some other minor Sections of the Indian Penal Code and u/s 12 of POCSO Act.

As per the prosecution case,this petitioner is alleged to have tried to drag the informant to a dark street after catching her hand and closing her mouth.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case because mother of petitioner has filed complaint case No. 214( C )/20 against the informant's mother, uncle and other family members. Both parties are neighbours and some altercation took place between them and for this both parties

Patna High Court CR. MISC. No.61064 of 2021(2) dt.06-07-2022 2/2 have filed case against each other. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VII-cum- Special Judge, POCSO Act, Patna in connection with Kadirganj PS case No. 69/2020, subject to conditions laid down u/s 438(2) of the Cr. P. C. (Prabhat Kumar Singh, J) BKS/- U T
