Heard the parties.
The petitioner apprehends his arrest in a case under sections 406 and 417 I.P.C.
The complainant alleged that the petitioner is the Branch Manager of Rashtriya Swarnim Rojgar Mission and he is its agent. The complainant deposited firstly Rs.15000/- as the membership fee and thereafter, deposited Rs.1,40,000/- after collecting from different persons.
It is submitted that the petitioner is ready to return the entire amount, if the complainant presents receipts showing the deposits of the amount duly signed by the petitioner. Considering the facts aforesaid, the petitioner, named above, in the event of his arrest/surrender before the court below within four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.41000 of 2014 (2) dt.02-04-2015 amount each to the satisfaction of Shri A.K. Gond, Judicial Magistrate, Ist Class, Khagaria in connection with Complaint Case No.256 © of 2012, subject to conditions as laid down under section 438(2) of the Cr.P.C.
It is further clarified that the complainant shall present the receipts duly signed by he petitioner before the court below and the court below shall fix a date on which the petitioner shall make payment to the complainant and if the petitioner fails to return the amount, the bail of the petitioner shall be cancelled.
