2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115(2), 118(1), 109, 324(4), 76, 303(2), 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita.

3. Learned counsel for the petitioners submits that petitioners have antecedent of one case and the informant alleges that Khedan and Ramesh assaulted her husband by Farsa causing injury on head, while Ramadhar assaulted her by Lathi

Patna High Court CR. MISC. No.49838 of 2025(2) dt.12-08-2025 2/3 causing injury on leg and Oshiyar assaulted her by bamboo on her knee thereafter female members of the family also assaulted and snatched her chain, further Babulal broke the mobile of her husband and Chandan broke the motorcycle.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that though it is alleged that Khedan and Ramesh assaulted her husband by Farsa causing injury on head but the injury suffered by the injured is opined to be simple in nature. It is next submitted that earlier Majhaulia P.S. Case No. 918 of 2022 was instituted by Ramadhar Yadav (father of petitioner no. 1) against the informant and their side alleging that sister of petitioner no. 1 was kidnapped by the informant, her husband and son.

Learned APP for the State opposes the prayer for anticipatory bail of the petitioners but they are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that injuries suffered by the injured is simple in nature and Ramadhar had earlier instituted the aforesaid Majhaulia P.S. Case No. 918 of 2022.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the

Patna High Court CR. MISC. No.49838 of 2025(2) dt.12-08-2025 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/successor Court in connection with Majhaulia P.S. Case No. 90 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
