Heard Mr. Rajesh Singh, learned Senior Counsel assisted by Mr. Manish Kumar Singh for the petitioner, learned APP for the State as well as learned counsel appearing on behalf of the informant.

The petitioner apprehends his arrest in connection with Sasaram Town P.S. Case No.495 of 2021, registered for the offences punishable under Sections 341, 354(A)(1), 427 and 506 of the Indian Penal Code and Section 8 of the POCSO Act. The petitioner is said to have tried to commit rape with the informant.

Learned Senior Counsel for the petitioner submits that

It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner is suffering from blood cancer and his disease is in advance stage. Learned counsel for the informant does not dispute this fact.

Considering the fact that the petitioner is suffering from blood cancer, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions JudgeVI-cum-Special Court (POCSO), Rohtas, Sasaram in connection with Sasaram Town P.S. Case No.495 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
